Property Finance

A lender’s documentation needs to work not only on day one, but also if a borrower defaults. We review existing documents to identify risk, improve enforceability and ensure that documents remain aligned with statutory and regulatory developments.
Loan management support
We support lenders through the full lifecycle of a loan, including loan management outsourcing where a disciplined legal process is needed to achieve a successful exit.
Redemptions
Our back-end redemption team deals with redemption statements, discharge documents and undertakings to lawyers acting for borrowers or incoming funders. We are used to last-minute redemption requests and understand the need for prompt, accurate completion.
Redemptions & Recoveries
Controlled, decisive action when lending matters move off plan.
Defaults can arise during the term of a loan, through breach of conditions or non-payment of interest, or at maturity when a borrower fails to repay. Our recoveries team helps lenders identify the most effective route to recovery and act quickly to protect their position.
Pre-action strategy
We issue demands for payment and letters before action, and advise on the most appropriate recovery route in light of the security, the borrower profile and the commercial objective.
Possession and enforcement
We act in issuing possession claims, obtaining warrants and writs of possession and progressing enforcement steps where security has to be realised.
Fixed Charge Receivers and mortgagee sales
We advise on the appointment of Fixed Charge Receivers and act on the sale of properties by mortgagees in possession or Fixed Charge Receivers, whether by private treaty or auction.
Complex recovery scenarios
Some recoveries involve multiple lenders, deeds of priority, debentures, administrators or third-party asset freezing orders. We advise on the additional steps required, including High Court applications where necessary.
Personal guarantees
Where a personal guarantee has been provided and realised assets do not discharge the debt, we pursue shortfall claims against guarantors where appropriate.
Conveyancing for Lenders & Receivers
We undertake conveyancing connected to remortgages, enforcement sales and sales by private treaty or auction for lender and receiver clients.
We do not offer residential conveyancing services to members of the public.
Landlord & Tenant
Specialists in landlord & tenant disputes.
Property disputes can be disruptive, time-sensitive and financially significant. We act swiftly to protect our clients' interests, whether the dispute concerns unpaid rent, possession, lease interpretation, service charges, breaches of covenant, dilapidations or business tenancy rights.
Our team has extensive experience representing both landlords and tenants in the County Court and the First-tier Tribunal. We combine technical expertise with practical commercial advice, helping clients resolve disputes through negotiation where possible and pursuing or defending court proceedings where necessary.
